Orange county museum of art aka ocma project

In May of 2022 The architecture firm Morphosis requested information regarding architectural photography for their most recent project, the Orange County Museum of Art aka OCMA. It was established that they would need a first round of photographs for internal and marketing purposes. CP+PM worked with the Morphosis team to generate an estimate specific to their needs.

COST SHARING & MULTI-USE

An important component of the estimate for this project included 2 additional cost sharing partners who would have equal, standard usage rights. This allowed the museum, the architects and the contractor to divide the cost of the shoot between 3 parties and retain equal, standard usage rights.

EDITORIAL LICENSING

In order to streamline the process of editorial licensing for this high profile project, CP+PM suggested the team include an Editorial Licensing Buyout as part of their package. This added, up front, fee eliminated any issues negotiating rates with 3rd parties who wanted to use the images for editorial features, but were either unwilling to pay, or did not have the budget to do so (this has become more commonplace as licensing budgets have dwindled). When one party pays the fee, in this case OCMA, they can feel confident pitching multiple outlets for editorial coverage knowing they have the rights to offer the images for no additional cost.

DEPOSIT, ARTIST AGREEMENT, SHOOT DATE & MORE

Once the estimate was approved, CP+PM worked to collect the deposit, get the Artist Agreement signed by all parties and confirm the shoot date in September of 2022. Due to the upcoming opening of the museum, the team was working on a tight deadline which required added fees for rush post production service. We worked quickly to ensure the final images were delivered in time for a front page feature in the Los Angeles Time’s “Entertainment & Arts” section in October of 2022. Later that October, we were thrilled when Morphosis and OCMA returned to request a second round of photographs, which were shot that same month after the museum had opened their doors.

3rd Party Image Licensing

From the time Mike’s images were featured in the Los Angeles Times, through present day, we continue to receive requests from 3rd parties to license the OCMA images for their own purposes. With a well thought out and pre-established rate, we have been able to offer each party a standard usage fee based on the number of images they need. Not only has this created added value for the photographer, but it has worked to protect the value of the images and the investment the original parties made in their procurement. In the event any images are used without the approval of the photographer, we kindly request they immediately be taken down if they are not agreeable to paying the appropriate fee. If a 3rd party continues to take advantage of an unlicensed image, legal action is required to cease and desist all usage.
